Defendants appeal presents three questions for review; whether the trial court erred in granting defendant CBIs (hereinafter known as appellee) motion for summary judgment on its crossclaim and counterclaim for specific performance of the contract; whether the trial court erred in denying defendant Wilda Brawleys (hereinafter known as appellant) motion to dismiss for failure to state a claim and alternative motion for summary judgment; and whether the trial court erred in denying appellants motion for summary judgment. We find no error and affirm.
